Not intrigued. ââ¬ËIf you were tuning in, youââ¬â¢d realize what I implied by truth. We will compose a custom paper test on The Good Man Jesus and the Scoundrel Christ Chapter 13 or on the other hand any comparable point just for you Request Now Iââ¬â¢m not one of these rationale choppers, these picky scholars, with their scented Greek garbage about an unadulterated universe of otherworldly structures where everything is great, and which is the main spot where the genuine truth is, not normal for this grimy material world which is degenerate and gross and loaded with falsehood and imperfectionâ⬠¦ Have you heard them? Inept inquiry. Youââ¬â¢re not intrigued by criticize either. ââ¬ËAnd slanderââ¬â¢s what it is; you made this world, and itââ¬â¢s exquisite, every last trace of it. At the point when I think about the things Iââ¬â¢ve cherished I wind up gagging with joy, or possibly distress, I donââ¬â¢t know; and all of them has been something in this world that you made. In the event that anybody can smell browning fish on a night by the lake, or feel a cool wind on a hot day, or see somewhat creature attempting to go around and tumbling over and getting up once more, or kiss a couple of delicate and willing lips, on the off chance that anybody can feel those things and still keep up theyââ¬â¢re only rough flawed duplicates of something much better in a different universe, they are defaming you, Lord, as doubtlessly as words mean anything by any means. Be that as it may, at that point they donââ¬â¢t figure words do mean anything; theyââ¬â¢re only tokens to play refined games with. Truth is this, and truth is that, and what is truth in any case, unendingly they go, these bloodless apparitions. ââ¬ËThe hymn says, ââ¬Å"The fool has said in his heart, There is no God.â⬠Well, I comprehend that fool. You regarded him as youââ¬â¢re treating me, didnââ¬â¢t you? In the event that that makes me a bonehead, Iââ¬â¢m one with all the numb-skulls you made. I love that fool, regardless of whether you donââ¬â¢t. The poor turf murmured to you after a long time after night, and heard nothing accordingly. Indeed, even Job, for all the difficulty he had, found a solution from you. In any case, the nitwit and I should talk into an unfilled pot, then again, actually even a vacant pot makes a sound like the breeze, on the off chance that you hold it over your ear. Thatââ¬â¢s an answer of sorts. ââ¬ËIs that what youââ¬â¢re saying to me? That when I hear the breeze, I hear your voice? When I take a gander at the stars I see your composition, or in the bark of a tree, or the waves on the sand at the edge of the water? Exquisite things, truly, every one of them, no uncertainty about that, yet for what reason did you make them so difficult to peruse? Who can decipher them for us? You hide yourself in conundrums and enigmas. Would i be able to accept that the Lord God would carry on like one of those scholars and make statements so as to astound and confound? No, I canââ¬â¢t trust it. For what reason do you treat your kin like this? The God who made water all things considered and sweet and new wouldnââ¬â¢t fill it with mud before offering it to his youngsters to drink. Things being what they are, whatââ¬â¢s the appropriate response? These things are brimming with your words, and we simply need to continue on till we can understand them? Or on the other hand theyâ â¬â¢re clear and aimless? Which right? ââ¬ËNo answer, normally. Tune in to that quietness. Not a breath of wind; the little creepy crawlies scratching endlessly in the grasses; Peter wheezing over yonder under the olives; a canine yelping on some homestead out behind me in the slopes; an owl down in the valley; and the endless quiet under everything. Youââ¬â¢re not in the sounds, are you. There may be some assistance in that. I love those little creepy crawlies. Thatââ¬â¢s a decent pooch out there; heââ¬â¢s reliable; heââ¬â¢d kick the bucket to take care of the ranch. The owl is wonderful and thinks about her young. Indeed, even Peterââ¬â¢s loaded with thoughtfulness, for all the commotion and the rant. In the event that I thought you were in those sounds, I could cherish you with my entire being, regardless of whether those were the main sounds you made. Be that as it may, youââ¬â¢re in the quiet. You don't utter a word. ââ¬ËGod, is there any distinction between saying that and saying youââ¬â¢re not there by any means? I can envision some philosophical smartarse of a minister in years to come pulling the fleece over his poor followersââ¬â¢ eyes: ââ¬Å"Godââ¬â¢s incredible nonattendance is, obviously, the extremely indication of his presenceâ⬠, or whatever hot air. The individuals will hear his words, and think that he is so smart to express such things, and theyââ¬â¢ll attempt to trust it; and theyââ¬â¢ll return home baffled and hungry, in light of the fact that it has neither rhyme nor reason. That minister is more awful than the numb-skull in the hymn, who in any event is a fair man. At the point when the blockhead appeals to you and finds no solution, he concludes that Godââ¬â¢s extraordinary nonattendance implies heââ¬â¢s not no doubt there. ââ¬ËWhat am I going to tell the individuals tomorrow, and the after quite a while after, and the day after that? Am I going to continue revealing to them things I canââ¬â¢t accept? My heart will become fatigued of it; my midsection will stir with ailment; my mouth will be brimming with debris and my throat will ignite with nerve. Thereââ¬â¢ll come a day when Iââ¬â¢ll state to some poor outsider that his transgressions are excused and his wounds will mend and heââ¬â¢ll state, ââ¬Å"But theyââ¬â¢re as terrible as they ever were. Where is this recuperating you promised?â⬠ââ¬ËAnd the Kingdomâ⬠¦ ââ¬ËHave I been misleading myself just as every other person? What have I up to, disclosing to them that itââ¬â¢s going to come, that there are individuals alive now who will see the happening to Godââ¬â¢s Kingdom? I can see us pausing, and pausing, and waitingâ⬠¦ Was my sibling right when he discussed this extraordinary association, this congregation of his that was going to fill in as the vehicle for the Kingdom on earth? No, he wasn't right, he wasn't right. My entire heart and psyche and body rebelled against that. They despite everything do. ââ¬ËBecause I can witness exactly what might if that sort of thing came to fruition. The fiend would rub his hands with joy. When men who accept theyââ¬â¢re doing Godââ¬â¢s will get hold of intensity, regardless of whether itââ¬â¢s in a family unit or a town or in Jerusalem or in Rome itself, the villain goes into them. It isnââ¬â¢t some time before they fire drawing up arrangements of disciplines for a wide range of honest exercises, condemning individuals to be lashed or stoned for the sake of God for wearing this or eating that or accepting the other. Furthermore, the special ones will manufacture incredible royal residences and sanctuaries to swagger around in, and demand burdens on the poor to pay for their extravagances; and theyââ¬â¢ll begin keeping the very sacred texts mystery, saying there are a few certainties too blessed to even think about being uncovered to the conventional individuals, so just the priestsââ¬â¢ translation will be permitted, and the yââ¬â¢ll torment and kill any individual who needs to make the expression of God clear and plain to all; and with consistently that passes theyââ¬â¢ll become increasingly dreadful, in light of the fact that the more force they have the less theyââ¬â¢ll trust anybody, so theyââ¬â¢ll have spies and disloyalties and revilements and mystery courts, and put the poor innocuous apostates they flush out to appalling open passings, to alarm the rest into dutifulness. ââ¬ËAnd every once in a while, to divert the individuals from their agonies and fire them with outrage against another person, the governors of this congregation will pronounce that such-and-such a country or such-and-such a people is abhorrent and should be demolished, and theyââ¬â¢ll accumulate extraordinary militaries and set off to murder and consume and plunder and assault and loot, and theyââ¬â¢ll increase their expectation over the smoking remains of what was previously a reasonable and prosperous land and announce that Godââ¬â¢s Kingdom is so much the bigger and progressively wonderful subsequently. ââ¬ËBut any minister who needs to enjoy his mystery cravings, his covetousness, his desire, his mercilessness, will wind up like a two-timer of sheep where the shepherd is bound and choked and blinded. Nobody will even consider scrutinizing the rightness of what this blessed man does in private; and his little casualties will cry to paradise for feel sorry for, and their tears will wet his hands, and heââ¬â¢ll wipe them on his robe and press them together devoutly and cast his eyes upwards and the individuals will say what a fine thing it is to have such a heavenly man as minister, how well he deals with the childrenâ⬠¦ ââ¬ËAnd where will you be? Will you look down and hit these reviling snakes with a thunderclap? Will you strike the governors off their seats and crush their castles to rubble? ââ¬ËTo approach the inquiry and sit tight for the appropriate response is to realize that there will be no answer. ââ¬ËLord, on the off chance that I thought you were tuning in, Iââ¬â¢d petition God for this most importantly: that any congregation set up in your name ought to stay poor, and frail, and unassuming. That it ought to use no authority aside from that of adoration. That it should never cast anybody out. That it should claim no property and make no laws. That it ought not denounce, yet just excuse. That it ought to dislike a castle with marble dividers and finished floors, and watches remaining at the entryway, however like a tree with its underlying foundations somewhere down in the dirt, that shields each sort of winged animal and monster and gives bloom in the spring and shade in the blistering sun and natural product in the season, and in time surrenders its great sound wood for the craftsman; yet that sheds a large number of seeds so new trees can develop in its place. Does the tree say to the sparrow, ââ¬Å"Get out, you donââ¬â¢t have a place here?â⬠Does the tree s ay to the ravenous man, ââ¬Å"This organic product isn't for you?â⬠Does the tree test the devotion of the brutes before it permits them into the shade? ââ¬ËThis is everything I can do now, murmur into the quietness. How much longer will I even want to do that? Youââ¬â¢re not there. Youââ¬â¢ve never heard me. Iââ¬â¢d improve to converse with a tree, to converse with a canine, an owl, a little grasshopper. Theyââ¬â¢ll consistently be there. Iââ¬â¢m with the blockhead in the song. You figured we could jump on without you; no ?C you didnââ¬â¢t care whether we jumped on without you or not. Sustainable agriculture drove human civilization from a hunter-gatherer society to the settled and centralized society we know today. The advent of modern agriculture techniques enabled early man to settle in one area and develop their own food and raw material needed for survival and sustainment. Such developments eliminated the need for small bands of hunters and gatherers to forage for food. Hunter-gatherer societies were constantly on the move in search for food and shelter. Constant movement and migrationâ⬠¦show more contentâ⬠¦Irrigation was of particular importance to the early Mesopotamians. ââ¬Å"For the development of man, the control of natural water resources and the utilization of water so controlled for the development of agriculture were no less important than either the discovery of the prac tical uses of fire or the discovery of the potential productivity of the earth or landâ⬠2. There is archeological evidence to suggest that grain was being grown along the Tigris and Euphrates as early as 4000 BC. The growing of grains and other food directly led to the rise of the Mesopotamian civilization. It can be shown that writing first developed around 3500 BC as a result of agriculture2. There began to develop commercial relationships between those who grew grain and those who used it. Mesopotamian farmers were not only growing grain and dates, but also keeping livestock such as sheep and goats. There is evidence to show this in the form of artwork from the period to demonstrate the importance of crop cultivation and animal husbandry in the area2. ââ¬Å"There can be no doubt that the type of land use markedly affected the social and political institutions of the people of the valleyâ⬠2. The first codified laws, known as the Code of Hammurabi, were written in Mesopotamia and spoke extensively on agriculture. Answer: Often the terms privacy and confidentiality are used interchangeably in daily life. However both the words have a different meaning with reference to the legal standpoint. According to Ryan, Callaghan and Large (2014) confidentiality means any private or personal information which has been shared with a physician, therapist, attorney or any other person which commonly cannot be disclosed to any third party except when express consent has been provided by the client. On the contrary privacy refers to the duty of not intruding in the personal information or matters of another person (Ahpra.gov.au 2017). The duty of maintaining confidentiality is a common law duty, however the right of privacy has its roots in the common law and is a legal duty. When it is stated that information is confidential there is an expectation that such information would not be shared unless expressed consent is provided. Privacy may arise out of using a restaurant wash room or any activity which is private. For instance the concept of confidentiality would arise out of a situation where the client had provided me with the information that he has a certain disease. Thus I am not supposed to disclose such fact to any other person without the authorization of the client. The concept of privacy would come into the picture in relation to a medical examination of the client. The legislation pertaining to privacy in Australia is known as the Privacy Act 1988. The Act is the regulator of the way in which personal information in relation to individuals is handled. Personal information is described as any information or opinion with respect to individual who can be identified or any individual who can reasonably be identified. There are 13 privacy principles included in the Privacy Act which are known as Australian Privacy Principles. The actor Lays down obligation and rights in relation to holding, accessing, using, handling and correcting personal information. In the case of Medical Board of Australia v William Fitzgerald the doctor was suspended for two and a half years as he was found to engage in a medical misconduct pertaining to privacy. The findings of the AHPRA were justified as the provisions of the Privacy Act had been violated. In the case of Nursing Midwifery Board of Australia v Claire Louise Crane conditions had been imposed on the registratio n of the nurse as she was found guilty of indulging in professional misconduct related to privacy. In this case also the findings of AHPRA were justified as it complied with the Privacy Act (Ahpra.gov.au 2017). Any person has a right to make a notification in a voluntary manner. However under National Law only health practitioners who are registered along with education providers and employers are mandatorily required to report notifiable conduct by making a mandatory reporting. It is the ethical and professional duty of all Healthcare practitioners to promote and protect public health and safe Health Care. It is mandatory required by such professionals to report on any conduct which can have an effect on the practice of a health practitioner. These conduct include practicing while being under the influence of drugs or alcohol, indulging in sexual harassment while practicing professional Healthcare, subjecting public to a substantial risk with respect to a health issue and exposing the public to a significant risk by departing from accepted professional conduct. There has to be a reasonable belief in the person making the notification that the other people have been involved in an act which constitutes notifiable conduct and they have reasonable grounds for such belief. There are certain exceptions which arise out of the situation in which the reasonable belief is created such as medico legal context. Education providers have to mandatorily report with respect to a health issue faced by a student which my place the public under significant risk during the course of clinical training (Ahpra.gov.au 2017). In case I knew that the RNs looked up for the colleagues information on the EPAS according to the facts of the scenario it would be my duty to make a mandatory notification in accordance to the rules discussed above. This is because the actions of the RNs would result in the infringement of privacy. It is the right of all individuals to maintain their privacy according to the provisions of the Privacy Act. The information which would have been provided by the nurse suspected to be hospitalized due to torture are kept confidential in the EPAS. Therefore if such information is taken without the consent of the nurse it would result in professional misconduct by the RNs even when they do not have any malicious intentions and are only looking for information because they are concerned. Where there is reasonable belief of a professional misconduct it is my duty to report search notifiable conduct under the provisions of mandatory notification. References Ahpra.gov.au. (2017). Here are 9 ways to say goodbye. 1.à Arrivederci! - Goodbye! At the end of a conversation, you can simply say ââ¬Å"arrivederciâ⬠and give a wave. While you might see the form ââ¬Å"arrivederlaâ⬠in textbooks, itââ¬â¢s often too formal- even to use with strangers- so you can stick with this form. On its own, itââ¬â¢s still very polite. 2.à A presto! - See you soon/Talk to you soon You could say this at the end of a friendly meeting with an acquaintance that you bumped into on the street or use it to end an email that youââ¬â¢ve written to a friend. Itââ¬â¢s more generic in nature, so itââ¬â¢s great to use when youââ¬â¢re not sure when the next meeting will be. A similar generic phrase would be, ââ¬Å"Alla prossima! - To the next time we meet!â⬠3.à A domani! - See you tomorrow! This phrase speaks for itself. You use it when you plan on seeing the next person the next day. Feel free to say it to aà barista you plan on seeing again tomorrow for your morning caffà ¨. 4. Ci vediamo presto - Weââ¬â¢ll see each other soon This phrase is often used between friends who you plan on seeing later on. You may also hear ââ¬Å"Ci sentiamo presto,â⬠à which means, ââ¬Å"Weââ¬â¢ll hear from each other soon.â⬠5. A risentircià - Until our next meeting This farewell phrase is very formal. Itââ¬â¢s often used in office/work language and at the end of phone calls as a polite closing form. The formal form of this phrase is, ââ¬Å"A risentirla.â⬠6. Torni presto! - Come again soon! This is something you might hear from a friend you made while on your trip. It will most likely be followed by a hearty ââ¬Å"buon viaggio! - have a good trip!â⬠à In the informal, it would be ââ¬Å"Torna presto,â⬠à and you may even hear ââ¬Å"Torna presto a trovarci! - Come again to visit us soon!â⬠7.à Mi à ¨ piaciuto moltoà - I enjoyed myself very much While this isnt a traditional phrase for saying goodbye, it is a great one to use if you want to start wrapping up a social event, like a friend showing you around his or her city. If you want to add something extra, you can also say: ââ¬Å"ÃË stata una bella giornata/serata. - It was a beautiful day/night.â⬠8.à Buonanotte! - Goodnight! The best time to say ââ¬Å"buonanotteâ⬠to someone is right before theyââ¬â¢re going to bed. If youââ¬â¢re leaving a social situation and you want to wish someone a good night, itââ¬â¢s best to stick with ââ¬Å"Buona serata,â⬠which means, ââ¬Å"Have a good evening.â⬠9.à Buon viaggio! - Have a good trip! This is a great phrase to use when someone tells you that theyââ¬â¢re going on a trip or are returning back home. If youââ¬â¢re visiting Italy, itââ¬â¢s one that youââ¬â¢ll hear often once you announce that youââ¬â¢re returning home. The ââ¬Å"buon nounâ⬠structure is used very often in Italian, and other phrases youââ¬â¢ll hear that help end conversations are: Buon proseguimento! - Enjoy the rest of (whatever action you were doing before the conversation started)!Buono studio! - Enjoy studying!Buon lavoro! - Enjoy working!Buona giornata! - Enjoy your day!Buona serata! - Enjoy your evening!Buon divertimento! - Have fun!Buon rientro! - Have a safe trip back home! joannbryan89http://www.blogger.com/profile/11102580482107269121noreply@blogger.com0tag:blogger.com,1999:blog-3837080512615434247.post-52254199106605990092020-02-24T23:29:00.001-08:002020-02-24T23:29:02.144-08:00Process of emotion in the workplace Essay Example | Topics and Well Written Essays - 750 wordsProcess of emotion in the workplace - Essay Example In exploring this topic, consider workplace factors that influence burnout, individual factors that influence employees to suffer exhaustion, and results of burnout. Emotion is considered as Energy in motion. Thatââ¬â¢s what it feels like, an energy moving through the body. Emotions are an attempt to express outwardly, to express what a person believes. Emotion is the central part of organizational life. The role of emotion has been studied through the consideration of emotional content of the job. Some jobs are characterized by the emotional labor and other jobs marked by a combination both genuine and managed emotion. Much of the emotion in the work place comes not from the nature of job but from relationship with others and day to day activities in the organization. Most research considers emotion that is controlled through training and employee manuals. The majority research shows that emotional exhibits that created through deep acting or surface acting is somehow not genuine indicators of true emotion. All job linked emotions do not have this feature. The problem with this conception of emotional labor is that it does not allow to instinctively and authentically experience and expresses expected emotion. There are times when workers feel real emotions on the job and express those emotions in interactions. This kind genuine emotion on the job often involves people who hold professional positions in industries such as health care, education, or human services. Workers in these roles rarely have instruction on emotion management that clearly spells out how to manage such situations. Still, such individuals do deal with a lot of emotion on the job both of a ââ¬Ëgenuineââ¬â¢ and ââ¬Ëmanagedââ¬â¢ variety. For example a nurse has to man age with the genuine emotion (e.g., the sorrow of having a patient die) and express emotions that he may not actually feel (e.g. dealing with ââ¬Ëdifficultââ¬â¢ patients in a cheerful or professional way). However, the effectiveness of the final scene to reflect the narratorââ¬â¢s catharsis is indisputable as it is accompanied by the song ââ¬Å"Where is My Mindâ⬠by The Pixies. The song itself is vital to the ending scene and ultimately the entire film. The lyrics are significant to the narratorââ¬â¢s inner turmoil, not only throughout the film, but also at the concluding moment and the auditory elements parallel the events and emotions of the concluding scene. Fight Club centers around an unnamed narrator who projects his unconscious identity as a separate character, Tyler Durdin. Tyler frees the narrator from his former pretenses of life regarding society through self destruction. The narrator burns his house, quits his job, and beings to live recklessly, seemingly by coincidence. He subconsciously rids himself of all worldly possessions. Together, Tyler and the narrator form Fight Club an underground group that thrives on destruction of themselves and government establishments. As the narrator gets weaker and less powerful, Tyler gets stronger and better looking, symbolizing his strengthening id. Towards the end of the film, the narrator comes to the realization that he is Tyler. The ending scene puts the narrator and Marla, a woman with whom he has an on again-off again relationship, at the highest story of a city building, holding hands and watching the city collapse around them. The music as it appears in the final scene is essential to the conclusion of the film The lyrics, ââ¬Å"where is my mind,â⬠plays at the very closing moment. The words reflect the state of the characterââ¬â¢s mind during the entire film and especially at the final scene. As he rids himself of all superficiality and societyââ¬â¢s values, he is freed from his dangerous alter ego and his apparent schizophrenia and left with an open mind. ââ¬Å"Where is my mind,â⬠speaks to the separation between his conscious and subconscious into two people as well as his newfound freedom from materiality. The narrator experiences a ââ¬Å"rebirthâ⬠from his prior lifestyle into pure existentialism, a state of being where he is now able to award meaning to his life, rather than society assigning meaning. The auditory elements of the song run parallel to the occurrences of the concluding scene. The song features loud, aggressive, and disharmonic music which is comparable to the cityââ¬â¢s crashing buildings and demolition. There is a melodic undertone of chorus voices singing which is reflective of the narrator and Marlaââ¬â¢s calmness and almost happiness, it seems, during the outside devastation. joannbryan89http://www.blogger.com/profile/11102580482107269121noreply@blogger.com0tag:blogger.com,1999:blog-3837080512615434247.post-28077585788907691152020-01-21T18:50:00.001-08:002020-01-21T18:50:03.646-08:00The Role of Women in Ancient Egyptian Society Essay -- Ancient Egypt WIt is difficult to fully understand the role of women in ancient Egyptian society because the understandings of the society and government are still incomplete. There are also two other major problems, those being that there is very little source material on women, and the material that has been found was biased by the ideas and minds of previous Egyptologists. The only source material that has survived from great kingdoms of Egypt is material that has been either found in tombs on the walls and sarcophaguses, or carved on major government and religious document. None of the writings on papyrus and other delicate materials survived. This material, which has survived, is the writings of the Egyptian literate male elite. In their writings the also did not show any emotions or feelings, this was not the style of the Egyptian people, writings were purely a record keeping device. Because of these limitations, ââ¬Å"It is essential to avoid the temptation to extrapolate from the par ticular to the general, a process which can only too easily introduce error.â⬠Upper class men, who had been schooled in their craft, did all the writings. As a result, there is very little material that deal with the lower peasant class. They were all illiterate and unable to record their tales. When studying women in Ancient Egypt, the great majority of the available texts discuss the lives of the upper class, which composed only a small percentage of the Egyptian population. In Pharonic Egypt, women were the legal equals of men. They were not denied any rights in accordance of the law because of their gender. Women, like men, could own property, coming into it either through inheritance, as a payment for goods or services, or through purchase. Women could buy houses and goods, and with them, they were allowed to do as they chose. Being landholders and people of property afforded ancient Egyptian women a reasonable amount of social freedom. They could travel about freely in towns without veiled faces. In their own homes, women could move about as they pleased, they were not forced to remain in one section of the house or forbidden from other common areas as they were in other societies of the time. Women could initiate legal proceedings, and they were responsible for their own actions. They could be the executors of wills and even sign their own marriage contrac... ... Egyptian women were looked at differently than men; their role was that of the nurturer and the caregiver, the bearer of a familyââ¬â¢s future. They were just as important to the society as the men. Ancient Egypt was a very complex world, and just as complex was the role that women played in its society. They were not free, but they also were not enslaved. They were vital, but only in terms of their husbands and their children. Egypt offered women a far more free life than the rest of the ancient world. In the end, women played a secondary role to men putting their desires for achievement aside so their husband could be king. Bibliography: Fischer, Henry George. Offer consumable products to the public that are proven to promote lasting wellness and healthââ¬âand do it in a personal way. Instead of dumping big bucks into traditional advertising, compensate anyone willing to share these products with their family and friends. In minimising traditional advertising, the companyââ¬â¢s marketing plan was developed as seen in Addendum A . This marketing plan is very simple and focuses primarily on sales and promotion levels of sellers. Since 1978, very little changes were done to keep up with trends over the years. 3.Business Mission Forever Living believes their greatest legacy is what they do for others and how they do it. ââ¬Å"We adhere to sustainable practices that let us work in harmony with the earth, leaving a more promising future to our children. We take great pride in our charity foundation, Forever Giving, because it allows us to help others around the world who has needs far greater than our own. We are taking ideas and turning them into reality. It is a part of our business thatââ¬â¢s so deeply ingrained you could call it our culture. Working towards a brighter future is so much more than our dutyââ¬âitââ¬â¢s truly our pleasure. Forever Living offers a unique opportunity where distributors are in business for themselves, but never by themselves.â⬠4.Objectives Seeing that the company primary focus is on sales, that is exactly what drives the objectives of the company. This is very clear in the current (unchanged) marketing plan still in use. The main objective is: Own your own business ââ¬â You are in charge of your own destiny. Instead of making your boss rich, all the work you do actually benefits you. Thus, the company tries to empower ordinary people with the ability to own an income related to the amount of effort put into sales and marketing based on known and proven products and catering for people with the same values in life. A promotion scheme is followed where the distributor starts at entry level and then progress to higher levels determined by the amount of sales accomplished. It seems like primarily the focus is based on the total of sales obtained, but on the other hand a strong emphasis is placed on customer satisfaction. 5.SWOT Analysis Strengths ââ¬â Being a company that has existed since 1978, it proves that this is no fly-by-night company. Sound records and proven results are in favour of establishing this company as a reputable business. Forever Living has a track record of more than 30 years of success. The company offer excellent training, seminars, incentives, and a support center. Forever Living is a company with an international presence that demonstrates stability, growth, and ample industry experience. Innovative, quality products speak of the credibility of the company. Weaknesses ââ¬â Seeing that the Forever Living Company, on customer related issues, primarily makes use of word-of-mouth marketing, as well as drawing the majority of costumers from family and friends, it seems like this could lead to a potential gap in their marketing plan. On the side of distributors, it seems like there is limited protocols and measurements regarding the amount of sale being monitored and available forà scruitinising. Thus, it seems like whatever sales you submit per month is the only way of monitoring your own progress in the company. Opportunities ââ¬â Although it could also be seen as a stumbling block, Forever Living Products utilise the opportunity to play the ecological card (which seems to be quite popular in recent trends) and puts a great deal of emphasis on being ââ¬Å"greenâ⬠and sustainable. As quoted they are: ââ¬Å"- Accountable to the Environment Ever since Forever Living Products was founded in 1978, weââ¬â¢ve had the utmost respect for nature. ââ¬â Not Just Greenwashing Our challenge to be more eco-friendly wasnââ¬â¢t based on following fads or silencing critics. In 2006 we launched a formal environmental sustainability program to challenge ourselves to do more. We designated two areas where we could improve: * Waste Generation * Waste Recovery Since we began monitoring our progress we have reduced our waste by 50% and increased our recycling from 26% to 61%. ââ¬â Our Carbon Footprint When it comes to the efficiency of converting CO2 into oxygen, 20 aloe plants are equal to one tree. With over 40 million aloe vera plants in our plantations, our Aloe Vera of America plantations actually cleanse the earth of 2 million tons of CO2 every year!â⬠https://www.foreverliving.com/marketing/Page.do?name=sustainability Threats ââ¬â Looking at the global economy, this could be a factor in reduced sales as Forever Living Products might be costly for costumers in countries (third-world countries) that are struggling economically. Few competition threats in relation to the product itself are known of as aloe vera productsà are limited by resources (aloe plants mostly grow in arid/ desert areas). Also, the amount of aloe vera in the base product makes this product range unrivaled by most other products. 6.Competitive Advantage For consumers, the Forever Living Companyââ¬â¢s product range is solely based on Aloe Vera products, which are divided into health drinks, nutritional supplements, weight management products and cosmetic / personal care products. This alone already gives the company a unique foothold on the health and beauty market ââ¬â a fresh approach with a definitive product focus. As for distributors, Forever Living also has the advantage of a multi-level ââ¬Å"step-upâ⬠promotion scheme for distributors where you can reach a certain level and not ââ¬Å"degradeâ⬠once you have reached that level. With this being said, other advantages are: Owning your own business ââ¬â You are in charge of your own destiny. Instead of making your boss rich, all the work you do actually benefits you. Little risk and no overhead costs ââ¬â Traditional brick-and-mortar businesses cost tens of thousands of dollars to establish, not to mention a bank loan that will take you decades to repay. Starting your home-based business with Forever Living only costs you a few hundred dollars. No salary cap ââ¬â Corporate jobs limit your pay range based on a market standard. With Forever Living, there is no cap on how much you earn. The harder you work, the more money you make. Residual Income ââ¬â Perhaps the greatest benefit is that the multi-level marketing strategy offers lasting income. You as a distributor will always earn commissions on distributors you introduce to Forever Living, continually reaping the benefits of your hard work. 7.Marketing Strategy 7a). Target Market As the companyââ¬â¢s unique product ââ¬â aloe vera ââ¬â is linked to many health and cosmetic benefits, it is a product that is sellable to virtually anyone. The target market is generally based on friends and/ or family buying from the distributor. This is not limited though to the above mentioned, but also includes people that have the urge or need to better their lives by living more healthy and doing so in reaching out to products (like Forever Living Products) that could sustain and/or improve that kind of living. Because of the relative high pricing linked to these products, one would classify the core target market as middle to high income groups. Being a sales orientated business, distributors are however expected to contact as many as potential ââ¬Å"consumersâ⬠to sell to and build up enough credit points (as part of the sales plan) to earn their compensation/rewards. Although a fair deal of business comprise of new business, a large part of sustaining and re-enforcing selling targets is based on repetitive sales from previous customers. 7b). Positioning The positioning basically rest on aforementioned health and cosmetic benefits ââ¬â to improve your way of life. With few competitors supplying specifically (certified) aloe vera products (keeping in mind that at least 75% of the base product must comprise of aloe vera), Forever Living has created a niche market and a unique selling opportunity. 7c). Marketing Mix Marketing to potential customers basically comprises of launch events, word-of-mouth and sample tests conducted in various environments suitable to potential customers. In this instance distributors seem to gather a group of people and thus present the products to various potential customers. This type of approach seem to work well in that people in numbers agreeing on an issue would more likely be proned to buying and thus push up the sale quota. As for distributors, Forever Living Products provides them with a simple, proven cycle that guarantees your success. If the distributor and their team members follow the steps in this cycle, there is no limit to how large their business will become and how much money you will earn. 1. Purchase a Business Pak 2. Develop a personal selling/marketing plan 3. Set your foundation by retailing four case credits per month 4. Follow up with your clients and prospects 5. Present the business opportunity 6. Sponsor new team members and guide them through the cycle i)Product Since the foundation in 1978, Forever Living Products markets extensively aloe vera based products. They pride themselves in claiming at least 75% of the base product consists of this core ingredient. Thus all products marketed are said to contribute to the health and cosmetic (e.g. skin care) satisfaction of their customers. Over the years, with the trend of energy drinks that became popular in recent years, the company made sure that the products offered also includes these trends. Focusing on a better living, the name Forever Living Products leans quite suitably towards what the company tries to ââ¬Å"sellâ⬠ââ¬â a longer, better, healthier life. The company also offers a full refund and/ or replacement of products without any disputes. What has been noted in delivery service is that customer service in this regard is very sufficient and fast ââ¬â 2 days delivery since placing an order to delivery on your doorstep. ii)Place Forever Living took a stance on the fact that they want to assist ordinary people to ââ¬Å"ownâ⬠their own businesses. As Forever Living Products markets primarily through the use of family and friends and word-of-mouth, it seems that there could be a gap in utilizing other means of distribution. However, it is also understandable that the company would like to empower distributors (without the necessity of holding a large stock reserve) and thus ensure that even the smallest distributor would be able to make aà living. This would furthermore project the products as being more exclusive ââ¬â not being able to walk into your nearest shop and pick it off the shelf, and in this way ââ¬Å"justifyâ⬠the price of the product. The home company is situated in Arizona, United States. The South African setup with four distributor outlets services distributors all over South Africa. iii)Promotion As mentioned earlier, products are primarily marketed by means of word-of-mouth, friends and family. Other means of marketing and advertising includes internet advertisements and online testimonials. All of these are rather inexpensive marketing tools being utilised. Through these channels is seems that there is sufficient affirmation to uphold the reputation of the products offered. However, with these channels used it seems to be difficult to obtain a clear estimation of the effectiveness of these efforts. On actual selling by distributors there is no clear indication of time spend, the only indication that could be used as a measure is the sum of ââ¬Å"case creditsâ⬠. Case credits determine the effective selling of a distributor. The more case credits accumulated during a month, the higher the incentives and possibility to progress to another level (often with even better incentives). The company tries to keep their products ââ¬Å"exclusiveâ⬠and thus the use of database marketing seems ineffective, as this would make the products seem ââ¬Å"commonâ⬠. In general, promotion of products for this company is based on testimonials from ââ¬Å"regular consumersâ⬠who can recommend the benefits to others. Through this line of advertising, it would seem that benefits of the products are more creditable, true and trustworthy ââ¬â due to the fact that you ââ¬Å"knowâ⬠the person who introduced you to the line of products. iv)Price Pricing on international products are generally seen as being expensive, especially on ââ¬Å"nicheâ⬠products. Even with Forever Living Products, this phenomenon occurs. However, focusing on health and cosmetic enhancements, the company can still make a reasonable stance in the pricing arena. 8.Implementation, Evaluation and Control The marketing plan appears to be in line with the goals set out by the company to achieve the desired goals. Primarily the activities required are achieved through sales of the distributors, which is measured on a monthly basis. Most probably the company would need to attempt a fresh approach on current marketing strategies such as e-commerce, although this could affect the purpose of the current structure and ââ¬Å"missionâ⬠of the company ââ¬â to empower ââ¬Å"normal people to own a business of their ownâ⬠. Seeing that performance standards are basically measured in the amount of sales per month (to achieve the desired ââ¬Å"case creditsâ⬠, this is the only way to measure the above mentioned. 9. Conclusion / Recommendations The Forever Living Products Company has set remarkable sales initiatives in place, rarely found in this type of marketing. For one, when a distributor has reached a certain sales level, there is no reverting back to a lower sales level. In every sale that is made down your line as distributor (no matter what level), you benefit from the inputs of ââ¬Å"your team. Although the company follows a very plain marketing plan, which seems to be quite effective, some improvements can be noted. Lack of information is found in the distributorsââ¬â¢ channels. As the companyââ¬â¢s main aim is based on sales, it could be recommended that an on-line ââ¬Å"portalâ⬠be created as to inform distributors of a current sales analysis (as of the first of every month, and therefore should be accessible and reflect updates any time of the month). This would pose to be a great motivational tool in driving thisà sales orientated business and ensuring that you as distributor acquire the necessary ââ¬Å"case creditsâ⬠required. It is also recommended that the use of social media such as e.g. television and radio, bill-boards and poster be used on a global and general scale to promote products. This would in turn mean that a central access point (like a website or telephone call centre be utilised to direct potential customers to their nearest distributor. Veganism can be characterized by someone who does not eat any animal products (Templeton). Mark F. McCarthy, a researcher explained, Vegetable protein reduces the risk of cancer, cardiovascular disease, and obesity (qtd. In Templeton). Although there are many different opinions on this plant-based diet, many wonder how this fits into religious beliefs. Christianity and Judaism are very different religions, but they have a large commonality. It does not matter what your eating practice is, so long as you slaughter in a humane way. Christianity, a religion that nearly a 7th of the world follows, has only one God. The only holy text followed is the Bible (Johnson, Christianity). In fact, most Christians believe this sacred text to be a love letter from God himself. With such a large written text, they do not have a cohesive diet. Stricter branches of this religion practice fasting during Lent, while the less restrictive branches just abstain from eating meat on Fridays during this time (Johnson, Christianity). The Bible has many conflicting verses regarding Veganism. For example Genesis 1:29-30 says that God gave his people all plants for food (The Holy Bible 12). Donââ¬â¢t waste time! Our writers will create an original "A Look On Veganism Through Religious Scope" essay for you Create order While later in Genesis 9:3 it states, Every moving thing that liveth shall be meat for you; even as the green herb have I given you all things. These verses conflict each other because one is saying that people are only supposed to eat greens, while the other is saying all moving things are food (The Holy Bible). In Genesis, God unleashes a horrific plague that would kill all firstborn sons of every family. He, however, told his followers to smear lambs blood across the top of their doorways to save their sons (The Holy Bible 214). In essence, this is trading a lambs life for a childs. Some may interpret this as putting the man before the animal. While others might interpret this as a huge sacrifice. While another verse in Luke 12:6 says 5 sparrows might be worth 5 pennies in our eyes, but they are valued just as much as we are in Gods eyes (The Holy Bible 3590). Because most verses in The Bible can be interpreted in many different ways, it makes finding a blunt verse regarding diet challenging. Judaism, a religion followed by 15 million people, closely follows The Torah. The Torah is the only holy text the Jewish follow. They believe in several holy figures, but the main one is Yahweh (Johnson, Judaism). The Jewish follow a strict diet called Kosher. Kosher only permits Jewish people to eat meat from cows, sheep, and domestic poultry. The diet does not include pork, shellfish, or birds of prey (Johnson, Judaism). The last and final restriction is the animals they eat have to be slaughtered in a humane way or they are not considered Kosher. The Torah has a clearer outlook on food restrictions regarding animals. For example, Thorns and thistles shall it sprout for you. But your food shall be the grasses of the field;. Another passage tells a story of two brothers and how one of them farmed the land and the other farmed sheep. One brother brought his first harvest to Yahweh while the other brought him his prized sheep. The brother that brought the sheep was paid, while the other was not (Jewish Publication Society of America). This passage says that Yahweh finds more value in the animal rather than the crop. While these verses may seem clear, like The Bible all verses in The Torah are open for interpretation. Christians do not have a specific diet they follow, but they do have one thing in common with Jews. Each religion believes in treating living things with the utmost respect and honor. This same theme follows for most of the Vegan and Meat eating communities. It does not matter what your eating practice is, so long as you slaughter in a humane way. According to the U.S. Bureau of the Census, the black family has declined from 80% in 1890 to 39% in 1990. The result of conflict, and warring souls in the African American community, this trend can be stopped and reversed. The African American family must first gain an understanding of what is causing this dissolution, then they can be taught about what principals and skills they must adapt in order to reverse it. Once this is accomplished, the black family must be given opportunities to share this information. By taking these steps, two-parent African American families would once again be prevalent in the United States. African Americans cannot bring an end to the warring souls in their communities if they do not know not what warring souls are. Therefore, African Americans must be taught. This teaching can come from schools, churches, or community events. Regardless, of where a person gains his or her knowledge, it is key that they understand what warring souls are. The scholar W.E.B. Du Bois saw warring souls as ââ¬Å"souls that are at conflict and war with one anotherâ⬠because ââ¬Å"one soul is alien, it is imposed from the outsideâ⬠(Tââ¬â¢Shaka 133). Thus, African Americans must understand that the war their soul is fighting is with a soul that is being force upon them. It is as follows: From the calculated table it can be said that, the group revenue was 61174 million in the year 2011, 64541 million in the year 2012, 63967 million in the year 2013, 64149 million in the year 2014, and 62996 million in the year 2015. This indicates that the average group revenue for the said five years is 63365 million. This implies revenue earning follows similar trend (Jaworski, Durante and Hardle, 2013). On the basis of the revenue earned in 2015, both high and low forecast for the year 2016 can be done and the result 69295.6 million for high forecast shows more revenue earnings, and 61106.12 million for low forecast shows lower revenue than the present, but not too low (McCraw, 2012). Similarly, the group trading profit was 3714 million in the year 2011, 3969 million in the year 2012, 3525 million in the year 2013, 3315 million in the year 2014 and 1390 million in the year 2015. This implies that with the decrease in the group revenue earning in the year 2015, the group trading profit has also decreased in the year 2015, as the group cost has increased in the year 2015 to 61606 million from 57460 million in the year 2011. The situation or the trend of the company for the five years can easily be understood and explained from the following line graph, column chart and pie chart (Ross, 2012): This line graph represents the group revenue of the company for five years. It is clear from the graph that, suddenly the revenue increases in the year 2012, then it started to fall slowly. This column graph represents the group trading profit of the company for five years. It is clear from the graph that, the highest profit occurred in the year 2012; the revenue earned was also highest. And the profit decreased most in the year 2015. This pie chart represents the group cost of the company for the five years, calculated by deducting the group profit from the group revenue (Thompson, 2012). This indicates that the cost was almost similar in the five years. References: Jaworski, P., Durante, F. and Hardle, W. (2013).Copulae in mathematical and quantitative finance. Berlin: Springer. Answer: Issues Whether the Burlington Insurance Co. has a duty to defend Crazy Horse in the suit filed against it by Mr. Martinez? Relevant Legal Principles The courts interpret the terms of an insurance policy on the basis of the meaning a layman would attach to the said terms. Accordingly, an insurer is under the duty to defend the insured if the claim falls within the ambit of the policy cover. But if the claim does not fall within the ambit of the coverage, the duty to defend does not arise. A duty to defend arises only in case, the insurer is aware of the facts at the commencement of the third party lawsuit. The ambit of the duty to defend is much broader as compared to the duty to indemnify. The fact that the insurer does not have a duty to defend corresponds to the fact that the insurer is not bound to indemnify the claimant. Application In the instant case, the insurance company had excluded its liability to defend the insured if it faces a lawsuit as a consequence of battery and assault. The main claim of Mr. Martinez was the harm caused to him because of the assault and battery inflicted to him by the Crazy Horse employees. As a result, Burlington is not bound to defend and indemnify Mr. Martinez. Conclusion From the above discussion, it may stated that Burlington is not bound to defend the suit on behalf of Crazy Horse or indemnify Mr. Martinez (Buckley, 1993). An assault may be defined to be the attempt to cause harm to another person, and it includes threats as well as behavior that is threatening. Assault is an attempt to harm another person by using force or violence. Assault is also defined to be an intended battery. On the other hand, a battery may be defined to be the harmful or intentional touching of the body of another person, sans the consent of such person (Dobbs, 1985). Similarities The similarities between the two are as follows; Both assault and battery relate to the causing of harm to another person. Both of these are intentional torts, as in both the cases; the act is intentional. The differences between the two are as follows; The assault has the effect of causing in the mind of the victim the fear of impending harm, even though harm is not caused. Whereas, a battery is the causing of harm to another person without the consent of such person(Williams, 2009). The purpose of assault is to threaten the other person, and that behind the battery is to cause harm to the other person. An assault may not involve physical contact with the victim but in case of battery physical contact is necessary (Fogg, 2009). Requirement of intention In case of assault, it is important to show that the person causing the assault intended the action that results in the assault. To constitute an offence of battery, the intention is not a necessary factor. Only offensive contact is required to constitute a battery, even though the person is not harmed or injured. This is not a case of intentional tort. The harm caused to Alicia by Marie was not intentional. The action of Marie was not initiated with the knowledge that it would harm Alicia. Thus, this is not an intentional tort. This is also not a case of intentional tort. The action of the store manager would not fall under either assault or battery. It would also not amount to false imprisonment. A shopkeeper has the privilege to keep in custody a suspected store lifter for a reasonable amount of time, as long as the said shopkeeper has reasonable belief that the person concerned has committed an offence or has attempted to commit an offence. But the period of such detention must be reasonable. In the given case, Malcolm did not detain Paris for a long time. Her detention was for a reasonable amount of time. Moreover, her detention falls within the privilege of the shopkeeper to detain a suspected store lifter. This is a clear case of intentional tort of sexual harassment. The tort of sexual harassment includes, physical or verbal conduct that is of a sexual nature and such conduct unreasonably interferes with the work of the victim, adversely affect the employment of the victim. In this case, Gina Lee intentionally discussed her sexual life with Brad. The act of brushing against Brad's crotch with her hips is also reason enough to constitute the offence of sexual harassment (G., 1942). Topic: Lawsuit against the manufacturer of Energy Drink Date of News: 23rd July 2015 Source of the News: The internet Summary of the News: Rockstar Beverage Corporation has recently been involved in a lawsuit because one of the consumers alleged to have suffered a heart attack after consuming four drinks within eight hours. Initially the plaintiff only suffered short breath and restlessness, but then he was informed that he had suffered a heart attack. It is the allegation of the plaintiff that though the company markets the drink to be safe, it has a high content of caffeine that risks the health of the consumers. The risk associated with the consumption of high amount of caffeine is not warned by the manufacturers. Relevance to the Content of this Course: This news seems relevant to the content of this course because it deals with the issue of personal injury (Turner, 2015). Fraud is a kind of typical intentional tort. Fraud is the legal term used for the conduct of intentionally lying to another person. The plaintiffs have to show that the defendant was aware of the fact that the statement made by him/ her is false and yet he/ she makes such a statement. The purpose of such false representation is to make the other person suffer loss as a consequence of relying on such representation. Misrepresentation is one of the bases for bringing an action under the law of torts. A misrepresentation may lead to civil liability in the case, it results in the pecuniary loss. Misrepresentation may be defined to be a manifestation or assertion by words of mouth or conduct. Such assertion or manifestation is not backed by facts. To make a misrepresentation actionable, the other person must have acted in reliance of such statement. It is not mandatory for the plaintiff to show that the person making the statement did so intentionally. The person would be held liable irrespective of malafide intention (Glannon, 2010). The similarities between the two may be stated as follows; In case of both misrepresentation and fraud, the making of a false statement is not essential. When a person fails to make a statement that he is obligated to make, it may result in fraud and misrepresentation. Invasion of Privacy When a person has a reasonable expectation of being left alone and there happens to be an intrusion of such expectation it results in an invasion of privacy. The four main types of invasion of privacy under the law of torts are as follows; Intrusion of an individual's solitude or private affairs If a person intrudes into the private affairs or solace of another person, whether physically or in any other way, the intrusion would be held actionable, if such action seems to be highly offensive to a person of reasonable prudence. Appropriation of the name or likeness of the plaintiff concerned If one person uses the name or likeness of another person without the consent of the concerned person, then the consequence would be the tort of this nature (Insurance. Accident Policy. Intentional Injury, 1915). The principle underlying this rule is that the name of a person is his/ her personal property. Disclosing publicly facts that are private to the plaintiff In case, a person discloses the private information publicly then a legal action may be brought against such person. However, such disclosure should be labeled as offensive as per the standard of a person of reasonable prudence. Putting the plaintiff under false light in the eyes of the public A claim for false light is somewhat similar to a claim for defamation. This right enables an individual to bring an action against the other individual. In the given problem, the tort of misrepresentation is applicable. There are three varieties of the tort of misrepresentation. These include, innocent misrepresentation occurs when a false statement is made without the knowledge of it being false, negligent misrepresentation occurs when the person making the false statement is expected to know better, and fraudulent misrepresentation occurs when a person knowingly makes a false statement in order to mislead the person concerned. In this case, Mike has made a false statement to Samuel without having proper knowledge. In the given situation, he is expected to know better about the paints. Thus, this is a case of negligent misrepresentation. In the given factual framework, the intentional tort of infliction of emotional distress is applicable. If a person caused another to suffer emotional distress, trauma or shock, then the victim has a right to bring an action against the other for infliction of emotional distress. In society individuals owe a duty of not inflicting emotional distress to other individuals. The term emotional distress includes any sort of mental anguish suffered by the victim as a consequence of the conduct of the tortfeasor. In the given case, Alex suffered emotional distress asa result of the malicious conduct of Maria. He even lost the opportunity to apply for the scholarship because of the conduct of Maria. In this case Maria is guilty of inflicting emotional distress to Alex. If the private affairs of an individual are disclosed by publicly by another in such a manner which is considered to be highly intrusive by a person of reasonable prudence then the said conduct would be deemed to be intrusion of privacy. There exist four varieties of intrusion of privacy. The fact that the statement is true cannot be a defense in an action for intrusion of privacy. In the given case we are concerned only about public disclosure of private facts. In this case, Gazette Herald has intruded the privacy of the participants of the alcoholics and plastic surgeons meeting by publishing about their personal affairs in the newspaper (Toxic-Shock SyndromeUnited States, 1997). Topic: Whether the Scottsdale Insurance Company, which is the insurer of Hunt Cub, under a policy of general insurance,, is liable to cover the actions of Johnson, a member of the club for his action of unintentionally shooting Denny Ray marks. Case Name/ Parties: Danny Ray Marks, Jr. and Timothy B. Johnson v. Scottsdale Insurance Company My comments on the decision of the court: The appeal court decided in favor of Scottsdale Insurance Company. The court applied ordinary meaning in order to interpret the intention of the parties from the terms of the policy. The terms of the policy as per appeal court are clear in this case. The insurance company would insure the members only with respect to the activities performed by the member or the club on behalf of the club. In this case, Johnson's action of hunting is not an activity performed on behalf of the club. Thus, the insurance company would not bear liability for Johnson's action in the suit filed by Mark (Smith, 1992). My decision, in case, I was the Judge: If I was the Judge in this case, my decision would have been the same as that of the judge in this case because the terms of the policy have clearly stated the purpose for which the insurance cover would be applicable and the conduct of Johnson was not covered by such policy (Anon, 2015). Intentional torts which cause injury to property rights are those actions of tort feasor's which interfere with the property owner's exclusive right to use his property without being interfered in any manner (Sinel, 2013). The following are included under this category; Trespass to land Toxic torts Trespass to chattel Slander of title Conversion Defamation by computer Commercial Disparagement (Shapo, 1990) The distinctions between intentional tort to person and property are as follows; Primarily, the intentional tort to person inures or causes harm to the person of the victim whereas intentional tort to property causes harm to the property of the victim. But this is the general rule, many-a-times in cases of intentional tort to property harm is caused to the person of the victim along with property. For instance, in case of toxic tort, the escape of harmful gas etc from the premises of the tor feasor may cause harm to the health as well as the property of the victim via the medium of property (Jain, 2006). When a person is accused of committing an intentional tort, the legal defense which would protect him for incurring liability for the harm caused to the person or property of the victim are commonly known as defenses. The principle underlying this rule is that some intentional torts are justified in law. When an action for committing intentional tort is brought against a person, the defendant has the right to bring to the notice of the court such facts which would have the effect of excuse his liability for causing harm to the plaintiff. Various defenses are available which the defendant may take recourse to. The courts then determine whether the privilege excuses the liability of the defendant. In case, the court is satisfied that the defendant has successfully established the existence of privilege, it would be deemed that the person concerned has not committed any tortuous act (Jasper, 2000). Privilege to commit the act is one of the situations under which defense may be raised. This defense may be taken for any sort of personal injury claim. This is the right of a person to engage in such a conduct which the majority of the individuals in the society do not have the right to engage in (Okrent and Buckley, 2010). This is a clear case of commercial disparagement. Commercial disparagement occurs when a person publicly makes untrue statements about the business, or goods or services of another person (Keeton and Prosser, 1984). The elements which constitute the tort of commercial disparagement includes the following; Making of false statement about the goods or business of another person The purpose behind making such statement is to disrepute the business of the other person (Okrent, 2015) Communication to the public In the instant case all of these ingredients are satisfied and hence we may say that Ben is guilty of the tort of commercial disparagement to the goods and services of the Chinese Restaurant, Tao. This is a case of defamation by computer. Computer databases have the potential to store various types of information about individuals. This tort results when inaccurate information about a person concerned is disseminated via the medium of computer. The elements of this tort include the following; Untrue information about the credit rating of a person Entering of such inaccurate data into the computer database Communication of such inaccurate information to the public Such inaccurate data has the effect of injuring the ability of the person concerned to acquire credit (Miller, n.d.). All these elements have been satisfied in the instant case. Thus, the accountant of the dentist is liable for the tort of defamation by computer to Ryan. In this case Kim is guilty of the intentional tort of causing damage to property belonging to another person. The defense available to Kim in this case is that of privilege. This defense protects a person from incurring liability for a tortuous action if that person can show that the act committed was intended to accomplish a social goal. In this case, the action of Kim was intended to protect the pedestrians and thus he is immune from the liability of causing harm to the vehicles (Morissette, 2009). In the suit brought by husband of the lady who was being tortured, Leroy can take the defense of person. He employed force in order to protect the person lady from the man. He was not aware that he was her husband. References Anon, (2015). [online] Available at: https://www.ca4.uscourts.gov/Opinions/Published/141823.P.pdf [Accessed 28 Jul. 2015]. Buckley, W. (1993). This was the war which changed the geo-political scenario of the world. Even today in some or the other form we still face the repercussions of this war. Germany bid for the 1936 XI Olympics in 1931, year in which Hitler had not surfaced so strongly. There were only two countries which bid for the hosting of the Olympic Games, Spain and Germany, out of which Germany won the bid with good voting margin. It is interesting to note that there were only two countries who bid for the games. The year 1931 was extremely depressing for the world. The crash of 1929 affected almost all the countries in a real adverse way. Germany was no different. Economic crisis is a phenomenon in which the society crumbles faster and deteriorates more than any other calamity. We have to understand this background to understand the extreme nationalism that rose to the surface. Adolf Hitler came to power 2 years prior to the Olympic Games in Germany. The racial and anti-Semitic policies adopted by him were becoming well known. Due to treaty of Versailles the size of the German military was restricted. The pretext of athletic training was used for military training. All these areas were banned for the Jews to participate in. It was not difficult for any political party for that matter to ignite the already inflammable conditions. In the third edition of his textbook (with E. Baur and E. Fischer), professor Fritz Lenz writes: "We must of course deplore the one-sided anti-Semitism of National Socialism. Unfortunately, it seems that the masses need such anti feelings... we cannot doubt that National Socialism is honestly striving for a healthier race.
